Article 1 - Purpose

These conditions aim to define the contractual relations between SASU TRESOR D'OLIVE - Campagne du Laval, route de Cucuron, 84160 Cadenet - France and the buyer as well as the conditions applicable to any purchase made through the merchant site "https://tresordolive.com/, whether the buyer is a professional or an individual.

Purchasing a product through this site implies unreserved acceptance by the buyer of these general terms and conditions of sale. SASU Trésor d'Olive reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 2 - Characteristics of the goods and services offered

The Site is an online sales site for olive products (hereinafter the “Products”) open to any natural or legal person using the Site (the “Customer”).

The Products presented on the Site are each the subject of a description (prepared by the supplier or accessible on the manufacturer's website via a link on the Site) mentioning their essential characteristics. The photographs illustrating, where applicable, the products do not constitute a contractual document. The instructions for use of the Product, if it is an essential element, appear on the Site or are at the latest sent upon delivery. The Products comply with the requirements of French law in force.

The Customer remains responsible for the terms and consequences of their access to the Site, particularly via the Internet. This access may involve the payment of fees to technical service providers such as Internet service providers, which remain their responsibility. In addition, the Customer must provide and be fully responsible for the equipment necessary to connect to the Site.

The Customer acknowledges having verified that the IT configuration he uses is secure and in working order.

Article 3 - Price

The prices of our products are indicated in Euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. The prices indicated on each item do not include shipping costs. These are indicated in the website's forwarding step: "Delivery".

Article 4 - Orders

The Operator strives to ensure optimal availability of its Products. Product offers are valid while stocks last. If, despite the Operator's best efforts, a Product proves to be unavailable after the Customer's order, the Operator will inform the Customer by email as soon as possible and the Customer will have the choice between:

  • The delivery of a Product of a quality and price equivalent to that initially ordered, or
  • Reimbursement of the price of the Product ordered no later than thirty (30) days from payment of the sums already paid.

It is agreed that apart from the reimbursement of the price of the unavailable Product, if this option is requested by the Customer, the Operator is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.

Except as otherwise provided in these General Conditions and without prejudice to the right of withdrawal provided for by applicable law, the Customer's orders are firm and final.

When placing an order, the Customer must select the chosen Products, add them to his basket by indicating the selected Products and the desired quantities. The Customer has the possibility to check the details of his order and its total price, and to
return to the previous pages to possibly correct the contents of your basket, before confirming it.

The Customer undertakes to read the General Terms and Conditions of Sale then in force before accepting them and to confirm the terms and conditions and any delivery and withdrawal costs prior to payment of his order. Confirmation of the order entails acceptance of the General Terms and Conditions and forms the contract.

The contractual information relating to the order will be confirmed by email in a timely manner and at the latest at the time of delivery. The Operator strongly advises the Customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice may be made available to the Customer upon explicit request.

Any email sent to the Customer in connection with an order will be sent to the email address that the Customer has provided to the Operator or the one that they use to log in to their customer area.

The Operator reserves the right not to validate the Customer's order for any legitimate reason, in particular in the event that:

The Operator archives Product sales contracts in accordance with applicable legislation. By submitting a request to the following address hello@tresordolive.com , the Operator will provide the Customer with a copy of the contract that is the subject of the request.

Any modification of the order by the Customer after confirmation of the order is subject to the agreement of the Operator.

The information provided by the Customer when placing the order (in particular name and delivery address) is binding on the Customer. Thus, the Operator cannot be held liable in any way in the event that an error when placing the order prevents or delays delivery/delivery.

The Client declares that he has full legal capacity to enter into a commitment under these General Conditions.

Registration is open to competent adults and minors, provided that they are supervised by a parent or guardian with parental authority. Registration is not permitted on behalf of third parties under any circumstances unless you are duly authorized to represent them (e.g., a legal entity).

Registration is strictly personal to each Customer. In the event of a breach by the Customer of any of the provisions herein, the Operator reserves the right to terminate the Customer's account without notice.

Article 5 - Validation of your order

Any order placed on the website www.tresordolive.com assumes
adherence to these General Conditions. Any order confirmation implies your full adherence to these general conditions of sale, without exception or reservation.

All data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you are fully aware of this.
The order confirmation will be worth signature and acceptance of the operations carried out.

A summary of your order information and these Terms
General, will be communicated to you in PDF format via the email address of
confirmation of your order.

Article 6 - Payment

By confirming your order, you are obligated to pay the price indicated.

When making a purchase, payment is made using the secure payment solution “Shopify Payments”.

Payment for your order is made directly online by credit card (CB, Visa, MasterCard). After confirmation of your payment by our payment service provider, your bank account will be debited with the total amount of your order.

We would like to reassure you that all your transactions are secure and comply with current legal requirements: they take place within a strict framework of confidentiality and encryption of all your data with our payment service provider. We do not have access to your personal data concerning your payment methods, particularly bank cards, at any time, and do not store them on our servers.

However, you may wish to save your bank details in your customer account so that they can be reused for future orders. To do this, simply check the "Save your payment details" box when you check out. In this case, our payment provider (and only our payment provider) will store your data in encrypted form. You can delete
the bank card that you have registered either directly in your customer account in the “My payment options” section, or by email by contacting our Customer Service.

This PCI-DSS certified platform guarantees fast and secure transactions. It accepts payments by CB (Bank Cards), Visa (French and foreign), Mastercard (French and foreign) and e-Carte Bleue.

The credit card number and other information are entered entirely within Shopify's system and servers. SASU Trésor d'Olive does not have access to this information, and we are not given any explanation in the event of a payment refusal. If the bank refuses payment, the order will be automatically canceled.

The card will only be debited when the order is shipped. In the case of split deliveries, only the products shipped will be debited.

Upon receipt of payment, we will send you your order.

Article 7 - Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty (with the exception of products that deteriorate and perish quickly).

Returns must be made in their original condition and complete (packaging, accessories, instructions) to the following address: Trésor d'olive, Campagne du Laval, Route de Cucuron, 84160 Cadenet. Any damage to the product in this case may invalidate the right of withdrawal. If the product has been opened, it cannot be returned.

Return costs are your responsibility.

In the event of exercising the right of withdrawal, the company Sasu Trésor d'Olive will reimburse the sums paid, upon receipt of the package, within 14 days following notification of your request and via the same means of payment as that used when ordering.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  • The supply of goods made to the consumer's specifications or clearly personalized.
  • The supply of goods liable to deteriorate or expire rapidly.
  • The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
  • The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items.

Article 8- Availability

Our products are offered as long as they are visible on the website www.tresordolive.com and in the
while stocks last. For products not in stock, our offers are
valid subject to availability.

If a product is unavailable after you have placed your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.

Article 9 - Delivery

The countries for which we can organize delivery are: Metropolitan France, Germany, Austria, Belgium, Spain, Italy, Luxembourg, Netherlands, Portugal.

Delivery means the transfer to the Customer of physical possession or control of the Product.

The Operator offers you different delivery or delivery methods depending on the nature of the product or your choice:

Shipping costs are those specified at the time of order completion and are accepted by the order confirmation. They will depend on the delivery option chosen, the amount of the order and the country of delivery.

The Operator undertakes, in accordance with the delivery deadline indicated on the Site for each of the Products, to deliver the Products within a maximum period of thirty (30) days after receipt of the order.

Delivery times are announced in working days on the Site when ordering. These times include the preparation and shipping of the order as well as the time provided by the carrier.

The Operator undertakes to ship the Products in accordance with the deadlines announced on each Product sheet and at the basket level, provided that payment for the order has not been previously refused.

However, if one or more Products cannot be delivered within the initially announced timeframe, the Operator will send an email indicating the new delivery date to the Customer.

The Products will be delivered to the address indicated by the Customer when ordering. It is therefore the Customer's responsibility to check that this address does not contain any errors. The Operator cannot be held liable if the address provided by the Customer is incorrect, thus preventing or delaying delivery.

Upon delivery, you may be asked to sign a receipt.

No deliveries will be made to a PO box.

Upon delivery, it is the Customer's responsibility to check that the Products delivered comply with their order and that the package is sealed and undamaged. If this is not the case, the Customer must indicate this on the delivery slip and take photos of the damage. No complaints regarding the quantity or condition of the Product will be accepted if the complaint has not been noted on the delivery slip.

The retention period for packages delivered to Relay Points is 7 days, and the period for packages delivered to Lockers (lockers) has been reduced to 5 days. If the Customer does not collect their package within the allotted time, the transport costs related to the return of the package and the new shipment of their order will be entirely at their expense.

Article 10 - Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, duly noted by Trésor d'Olive, it may be returned, exchanged or refunded to the exclusion of any compensation or damages.

Article 11 - Liability

The products offered comply with current French legislation. Sasu Trésor d'Olive cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the import or use of the products or services you plan to order.

Furthermore, Sasu Trésor d'Olive cannot be held responsible for damage resulting from improper use of the product purchased.

Finally, the liability of the company Sasu Trésor d'Olive cannot be engaged for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the
presence of computer viruses.

Article 12 - Applicable law in the event of disputes

These General Conditions are governed, interpreted and applied in accordance with French law.

Article 13 - Intellectual property

All elements of the site www.tresordolive.com are and remain the intellectual and exclusive property of the company Sasu Trésor d'Olive.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the written consent of Sasu Trésor d'Olive.

Article 14 - Personal data

Sasu Trésor d'Olive reserves the right to collect personal information and data about its customers. This information is necessary for order management and to improve the services and information we provide to you.

Sasu Trésor d'Olive undertakes not to disclose any information provided by the buyer to third parties. All personal data concerning the buyer is recorded and processed by Sasu Trésor d'Olive in complete confidentiality.

This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and data concerning you, directly on the website. Sasu Trésor d'Olive uses cookies. Click on the icon at the bottom left of the pages to change your cookie preferences.

Article 15 - Archiving Evidence

Sasu Trésor d'Olive will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerized records of the company Sasu Trésor d'Olive will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
